Welcome to Underdog Dumpster. These Terms & Conditions ("Terms") govern your use of our website (underdogdumpster.com) and the rental services we provide. By accessing our Site or renting a dumpster from us, you agree to these Terms.
Kennedy Family Holding, LLC d/b/a Underdog Dumpster ("we," "us," or "our") provides roll-off dumpster rental services in Middle Tennessee.
SERVICES PROVIDED
We offer 10-yard, 15-yard, and 20-yard roll-off dumpster rentals for residential and commercial use. We do not provide junk removal, front-load dumpster service, permanent waste service, 30-yard dumpsters, or portable restroom rentals.
ELIGIBILITY
You must be at least 18 years of age and legally able to enter into contracts to rent from us. By placing an order, you represent that you meet these requirements. Use of our Site, services, and SMS program is intended solely for adults aged 18 and older.
BOOKING, PRICING, AND PAYMENT
- Prices displayed on our Site include the rental fee for the stated rental period.
- Additional charges may apply for overage weight, prohibited items, damage, extension days, or relocation.
- Payment is required at time of booking via credit card through our payment processor (Stripe).
- We store a payment method on file for the duration of the rental to process any applicable additional charges in accordance with your signed rental agreement.
DELIVERY AND PICKUP
- You are responsible for providing a safe, level, accessible drop location with sufficient overhead clearance and ground space.
- We place heavy-duty plastic strips under the steel wheels of each dumpster to protect your driveway. We are not liable for pre-existing cracks, weak pavement, sealcoat damage, or other surface issues beyond our reasonable control.
- You are responsible for obtaining any permits required by your local municipality for street placement.
PERMITTED AND PROHIBITED MATERIALS
Prohibited materials include: hazardous waste, tires, wet concrete (unless pre-arranged), refrigerators and appliances containing freon, batteries, propane tanks, medical waste, liquids, and contaminated soils. Placement of prohibited items will result in additional fees.
UNDERDOG DUMPSTER SMS PROGRAM TERMS
Program Name: Underdog Dumpster SMS Program
Program Description: Underdog Dumpster operates a transactional SMS program that sends order and service notifications to customers who have opted in. This is a non-marketing program. We do not send promotional, advertising, or marketing content via SMS.
Messages sent through this program include, but are not limited to:
- Order and booking confirmations
- Delivery window notifications
- Driver arrival notifications
- Pickup reminders and confirmations
- Account and service updates
- Quote request responses
Expected message frequency: Varies based on rental activity. Typically 2 to 6 messages per active rental.
Opt-In: Customers opt in by checking the SMS consent checkbox at checkout (underdogdumpster.com/checkout/) or on the contact form (underdogdumpster.com/contact-us/), or by providing verbal consent during a phone call. The consent checkbox is unchecked by default and is not required to submit the form or complete a purchase. Consent is not a condition of purchase.
Opt-Out (Reply STOP): To opt out of SMS messages at any time, simply reply STOP to any text message you receive from Underdog Dumpster. You may also reply with any of these keywords: UNSUBSCRIBE, CANCEL, END, or QUIT. After opting out, you will receive a final confirmation message and will no longer receive SMS communications from us.
Additional Opt-Out Methods:
- Call (931) 453-0667 and request removal from SMS notifications
- Email info@underdogdumpster.com with an opt-out request
Rejoining: To resume SMS communications after opting out, you may re-opt in through any of the methods listed in the Opt-In section above.
Help (Reply HELP): For support with our SMS program, reply HELP to any message, call (931) 453-0667, or email info@underdogdumpster.com.
Message and Data Rates: Message and data rates may apply to any SMS messages you receive from or send to Underdog Dumpster. These rates are determined by your mobile carrier and are not charged by Underdog Dumpster. Standard carrier rates for text messages will apply per your mobile plan. Check with your mobile carrier for details on your plan.
Carrier Liability: Underdog Dumpster and participating mobile carriers are not liable for delayed or undelivered SMS messages. Message delivery is subject to the effective transmission from your network operator and is outside the control of Underdog Dumpster. We cannot guarantee delivery of all messages, and we are not responsible for:
- Messages delayed or not delivered due to carrier issues
- Messages filtered as spam by your carrier
- Messages not received due to device, network, or service interruptions
- Any charges incurred as a result of receiving our messages
Compliance with Industry Standards: Our SMS program is operated in compliance with the CTIA Messaging Principles and Best Practices, the Telephone Consumer Protection Act (TCPA), and applicable state and federal regulations governing commercial text messaging.

CANCELLATIONS AND REFUNDS
Cancellations and refunds are governed by our Refund Policy. Cancellations 48 or more hours before scheduled delivery receive a full refund. Cancellations within 48 hours receive a 50% refund or full credit. Same-day cancellations after dispatch are non-refundable.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Underdog Dumpster's liability for any claim arising out of or related to our services is limited to the amount paid by you for the specific rental in question. We are not liable for indirect, incidental, consequential, or punitive damages.
INDEMNIFICATION
You agree to indemnify and hold Underdog Dumpster harmless from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of our services, improper use of the dumpster, placement of prohibited materials, or violation of these Terms.
GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Tennessee. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Montgomery County, Tennessee.
ELECTRONIC SIGNATURES
You agree that electronic signatures, acceptance of Terms via checkout, and SMS/email acknowledgments constitute valid and binding agreements under the Tennessee Uniform Electronic Transactions Act (UETA).
CHANGES TO THESE TERMS
We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of our services after changes constitutes acceptance of the updated Terms.
